Welcome to the Black Bear Construction website. By accessing this website or engaging our services, you agree to comply with and be bound by the following terms and conditions of use.
1. Scope of Services
Black Bear Construction provides professional construction and concrete installation services, including but not limited to driveways, walkways, foundations, and retaining walls. All projects are subject to a formal written estimate and a signed Work Authorization or Contract.
2. Estimates and Proposals

Validity: All quotes and estimates are valid for 30 days from the date of issuance due to fluctuating material costs (e.g., concrete and lumber).

Site Conditions: Estimates are based on visible site conditions. Black Bear Construction is not responsible for unforeseen underground obstructions (e.g., undocumented utility lines, excessive caliche, or abandoned septic tanks) unless otherwise specified in the contract. Additional labor or equipment required for such conditions may result in a "Change Order" and additional fees.
3. Payment Terms

Deposits: A mobilization deposit (typically 130%) may be required to schedule your project and secure materials.

Progress Payments: For large-scale projects, progress payments may be required at specific milestones (e.g., completion of forming, completion of pour).

Final Payment: The remaining balance is due immediately upon the completion of the project. Late payments may be subject to a finance charge as permitted by Arizona law.
4. Customer Responsibilities

Access: The customer must provide clear access to the work site for heavy machinery and concrete trucks.

Permits: Unless explicitly stated in the contract, the customer is responsible for obtaining any necessary Homeowners Association (HOA) approvals. Black Bear Construction will handle standard city/county building permits as specified in the project proposal.

Utilities: The customer is responsible for marking any private underground lines (e.g., irrigation, landscape lighting, or private power) that are not covered by Blue Stake (811) location services.
5. Concrete Disclaimer & Warranty

Cracking: Concrete is a natural material that is prone to shrinkage and cracking. While Black Bear Construction uses industry-standard reinforcement (rebar/fiber) and control joints to manage cracking, we cannot guarantee that no cracks will occur, particularly in the extreme temperature shifts of the Mojave Desert.

Color Variation: Minor variations in concrete color and texture are normal and can be affected by weather conditions during the pour.

Warranty: We provide a one-year limited warranty on structural integrity and workmanship. This does hairline cracks, "spider" cracks, or damage caused by subgrade settlement beyond our control, chemical spills, or use of heavy machinery exceeding the design PSI.
6. Limitation of Liability
Black Bear Construction shall not be liable for any indirect, incidental, or consequential damages arising from the use of our website or services. Our total liability for any claim arising out of a project shall not exceed the total amount paid by the customer for that specific project.
7. Governing Law
These terms are governed by the laws of the State of Arizona. Any disputes arising from these terms or our services shall be resolved in the courts of Mohave County, AZ.
